Terms and Conditions of the Online Store

§1. General Provisions

1. The online store is operated by TimberCraft, based in Poręba Wielka, NIP: 7372133304, REGON: 383680280, hereinafter referred to as the "Seller".

2. These terms and conditions define the rules for using the online store, placing orders, delivery execution, and complaint procedures.

§2. Definitions

The terms used in these terms and conditions mean:

1. Customer – a natural person, legal person, or organizational unit making a purchase.
2. Consumer – a natural person making a purchase unrelated directly to business activity.
3. Product – garden sauna or another product offered in the store.
4. Order – the Customer's declaration of intent aimed at concluding a sales contract.

§3. Product Information

1. Products offered in the store are made according to the descriptions provided on the website.
2. Product photos are for illustrative purposes only. Due to the natural properties of wood, there may be differences in color, grain, and material structure.
3. Product dimensions may differ from those stated in the description by values resulting from the manufacturing process and wood properties.
4. The Seller reserves the right to make technological changes that do not worsen the product quality.

§4. Placing Orders

1. Orders can be placed through the website 24 hours a day.
2. The condition for order fulfillment is providing correct contact and address details.
3. After placing an order, the Customer receives confirmation of its acceptance electronically.
4. The sales contract is concluded at the moment of the Seller confirming the acceptance of the order.

§5. Prices and Payments

1. All prices are quoted in Polish zlotys and include VAT.
2. The shipping cost is indicated when placing the order or determined individually.
3. Available payment methods:
   • bank transfer,
   • online payment,
   • deposit.
4. The Seller may require a deposit in the amount specified in the offer or order confirmation.

§6. Order Fulfillment

1. The order fulfillment period is from 2 to 8 weeks from:
   • the accounting of the required payment,
   • confirmation of all order parameters.
2. The fulfillment period may change for reasons beyond the Seller's control, particularly due to:
   • delays in material deliveries,
   • force majeure,
   • weather conditions preventing transport or assembly.
3. The Customer will be informed of any change in the deadline.

§7. Delivery

1. Delivery is carried out within Poland and other countries upon individual arrangement of terms.
2. The Customer is obliged to ensure access for the delivery vehicle and unloading of the product.
3. The Customer should prepare the sauna placement site according to the guidelines provided by the Seller.
4. The risk of accidental damage to the product passes to the Customer at the moment of product release.

§8. Assembly and Ground Preparation

1. Unless the parties agree otherwise, the price includes the delivery of the finished sauna.
2. The Customer is responsible for preparing the appropriate ground before delivery.
3. The Seller is not responsible for the consequences of placing the sauna on improperly prepared ground.
4. Detailed requirements regarding foundations or ground are communicated to the Customer before order fulfillment.
5. The sauna location should protect the wood from excessive sunlight and moisture – placement near trees, shrubs, or in full sunlight may accelerate wood erosion, which is not covered by warranty.

§9. Right of Withdrawal

1. The Consumer has the right to withdraw from a distance contract within 14 days of receiving the product.
2. The right of withdrawal does not apply to products made according to the Consumer's specifications or intended to meet their individualized needs, in accordance with Article 38 point 3 of the Consumer Rights Act.
3. If the sauna was made to the Customer's individual order (e.g., non-standard dimensions, equipment, color), withdrawal from the contract after production has started is not possible.

§10. Complaints

1. The Seller is responsible for the product's compliance with the contract in accordance with applicable law.
2. Complaints can be submitted:
   • electronically at biuro@timbercraftkonstrukcje.pl,
   • in writing to the Seller's registered office.
3. The complaint should be prepared on the Seller's complaint form and should include, in particular:
   • Customer data,
   • description of the defect,
   • photographic documentation (if possible).

5. The seller will consider the complaint within 14 days of receiving it.

§11. Warranty

1. If a warranty is provided with the product, its terms are specified in a separate warranty document.
2. The warranty does not exclude, limit, or suspend rights arising from the provisions on liability for the conformity of goods with the contract.

§12. Personal data protection

1. The administrator of personal data is TimerCraft.
2. Personal data is processed for the purpose of fulfilling orders and in accordance with applicable laws.
3. Detailed information can be found in the Privacy Policy available on the website.

§13. Final provisions

1. In matters not regulated, the provisions of Polish law shall apply.
2. Any disputes will be resolved by the competent courts in accordance with applicable regulations.
