Terms and Conditions of the Online Store

 

§1. General Provisions

  1. The online store is operated by TimberCraft, based in Poręba Wielka, NIP: 7372133304, REGON: 383680280, hereinafter referred to as the "Seller".

  2. These terms and conditions define the rules for using the online store, placing orders, delivery execution, and complaint procedures.

§2. Definitions

The terms used in these terms and conditions mean:

  1. Customer – a natural person, legal person, or organizational unit making a purchase.
  2. Consumer – a natural person making a purchase unrelated directly to business activity.
  3. Product – garden sauna or another product offered in the store.
  4. Order – the Customer's declaration of intent aimed at concluding a sales contract.

 

§3. Product Information

  1. Products offered in the store are made according to the descriptions provided on the website.
  2. Product photos are for illustrative purposes only. Due to the natural properties of wood, there may be differences in color, grain, and material structure.
  3. Product dimensions may differ from those stated in the description by values resulting from the manufacturing process and wood properties.
  4. The Seller reserves the right to make technological changes that do not worsen the product quality.

 

§4. Placing Orders

  1. Orders can be placed through the website 24 hours a day.
  2. The condition for order fulfillment is providing correct contact and address details.
  3. After placing an order, the Customer receives confirmation of its acceptance electronically.
  4. The sales contract is concluded at the moment of the Seller confirming the acceptance of the order.

 

§5. Prices and Payments

  1. All prices are quoted in Polish zlotys and include VAT.
  2. The shipping cost is indicated when placing the order or determined individually.
  3. Available payment methods:
    • bank transfer,
    • online payment,
    • deposit.
  4. The Seller may require a deposit in the amount specified in the offer or order confirmation.

 

§6. Order Fulfillment

  1. The order fulfillment period is from 2 to 8 weeks from:
    • the accounting of the required payment,
    • confirmation of all order parameters.
  2. The fulfillment period may change for reasons beyond the Seller's control, particularly due to:
    • delays in material deliveries,
    • force majeure,
    • weather conditions preventing transport or assembly.
  3. The Customer will be informed of any change in the deadline.

 

§7. Delivery

  1. Delivery is carried out within Poland and other countries upon individual arrangement of terms.
  2. The Customer is obliged to ensure access for the delivery vehicle and unloading of the product.
  3. The Customer should prepare the sauna placement site according to the guidelines provided by the Seller.
  4. The risk of accidental damage to the product passes to the Customer at the moment of product release.

 

§8. Assembly and Ground Preparation

  1. Unless the parties agree otherwise, the price includes the delivery of the finished sauna.
  2. The Customer is responsible for preparing the appropriate ground before delivery.
  3. The Seller is not responsible for the consequences of placing the sauna on improperly prepared ground.
  4. Detailed requirements regarding foundations or ground are communicated to the Customer before order fulfillment.
  5. The sauna location should protect the wood from excessive sunlight and moisture – placement near trees, shrubs, or in full sunlight may accelerate wood erosion, which is not covered by warranty.

 

§9. Right of Withdrawal

  1. The Consumer has the right to withdraw from a distance contract within 14 days of receiving the product.
  2. The right of withdrawal does not apply to products made according to the Consumer's specifications or intended to meet their individualized needs, in accordance with Article 38 point 3 of the Consumer Rights Act.
  3. If the sauna was made to the Customer's individual order (e.g., non-standard dimensions, equipment, color), withdrawal from the contract after production has started is not possible.

 

§10. Complaints

  1. The Seller is responsible for the product's compliance with the contract in accordance with applicable law.
  2. Complaints can be submitted:
    • electronically at biuro@timbercraftkonstrukcje.pl,
    • in writing to the Seller's registered office.
  3. The complaint should be prepared on the Seller's complaint form and should include, in particular:
    • Customer data,
    • description of the defect,
    • photographic documentation (if possible).

  5. The seller will consider the complaint within 14 days of receiving it.

 

§11. Warranty

  1. If a warranty is provided with the product, its terms are specified in a separate warranty document.
  2. The warranty does not exclude, limit, or suspend rights arising from the provisions on liability for the conformity of goods with the contract.

 

§12. Personal data protection

  1. The administrator of personal data is TimerCraft.
  2. Personal data is processed for the purpose of fulfilling orders and in accordance with applicable laws.
  3. Detailed information can be found in the Privacy Policy available on the website.

 

§13. Final provisions

  1. In matters not regulated, the provisions of Polish law shall apply.
  2. Any disputes will be resolved by the competent courts in accordance with applicable regulations.

Regulamin określa zasady korzystania ze sklepu internetowego TimberCraft, składania zamówień, realizacji dostaw oraz procedury reklamacyjne. Zapraszamy do zapoznania się z poniższymi postanowieniami.

§1 Postanowienia ogólne
  1. Sklep internetowy prowadzony jest przez firmę TimberCraft, z siedzibą w Poręba Wielka, NIP: 7372133304, REGON: 383680280, zwany dalej „Sprzedawcą".
  2. Regulamin określa zasady korzystania ze sklepu internetowego, składania zamówień, realizacji dostaw oraz procedury reklamacyjne.

§2 Definicje

Użyte w Regulaminie pojęcia oznaczają:

  1. Klient – osoba fizyczna, osoba prawna lub jednostka organizacyjna dokonująca zakupu.
  2. Konsument – osoba fizyczna dokonująca zakupu niezwiązanego bezpośrednio z działalnością gospodarczą.
  3. Produkt – sauna ogrodowa lub inny produkt oferowany w sklepie.
  4. Zamówienie – oświadczenie woli Klienta zmierzające do zawarcia umowy sprzedaży.
§3 Informacje o produktach
  1. Produkty oferowane w sklepie są wykonywane zgodnie z opisami zamieszczonymi na stronie internetowej.
  2. Zdjęcia produktów mają charakter poglądowy. Ze względu na naturalne właściwości drewna mogą występować różnice w kolorystyce, usłojeniu oraz strukturze materiału.
  3. Wymiary produktów mogą różnić się od podanych w opisie o wartości wynikające z procesu produkcyjnego i właściwości drewna.
  4. Sprzedawca zastrzega możliwość wprowadzania zmian technologicznych niepogarszających jakości produktu.
§4 Składanie zamówień
  1. Zamówienia można składać przez stronę internetową 24 godziny na dobę.
  2. Warunkiem realizacji zamówienia jest podanie prawidłowych danych kontaktowych i adresowych.
  3. Po złożeniu zamówienia Klient otrzymuje potwierdzenie jego przyjęcia drogą elektroniczną.
  4. Umowa sprzedaży zostaje zawarta z chwilą potwierdzenia przyjęcia zamówienia przez Sprzedawcę.
§5 Ceny i płatności
  1. Wszystkie ceny podawane są w złotych polskich i zawierają podatek VAT.
  2. Koszt transportu wskazywany jest podczas składania zamówienia lub ustalany indywidualnie.
  3. Dostępne formy płatności:
    • przelew bankowy
    • płatność online
    • zaliczka
  4. Sprzedawca może wymagać wpłaty zaliczki w wysokości określonej w ofercie lub potwierdzeniu zamówienia.
§6 Realizacja zamówienia
  1. Termin realizacji zamówienia wynosi od 2 do 8 tygodni od:
    • zaksięgowania wymaganej wpłaty
    • potwierdzenia wszystkich parametrów zamówienia
  2. Termin realizacji może ulec zmianie z przyczyn niezależnych od Sprzedawcy, w szczególności z powodu:
    • opóźnień dostaw materiałów
    • siły wyższej
    • warunków pogodowych uniemożliwiających transport lub montaż
  3. O każdej zmianie terminu Klient zostanie poinformowany.
§7 Dostawa
  1. Dostawa realizowana jest na terenie Polski oraz innych krajów po indywidualnym ustaleniu warunków.
  2. Klient zobowiązany jest zapewnić możliwość dojazdu pojazdu dostawczego oraz rozładunku produktu.
  3. Klient powinien przygotować miejsce posadowienia sauny zgodnie z wytycznymi przekazanymi przez Sprzedawcę.
  4. Ryzyko przypadkowego uszkodzenia produktu przechodzi na Klienta z chwilą wydania produktu.
§8 Montaż i przygotowanie podłoża
  1. O ile strony nie ustalą inaczej, cena obejmuje dostawę gotowej sauny.
  2. Klient odpowiada za przygotowanie odpowiedniego podłoża przed dostawą.
  3. Sprzedawca nie odpowiada za skutki posadowienia sauny na nieprawidłowo wykonanym podłożu.
  4. Szczegółowe wymagania dotyczące fundamentów lub podłoża są przekazywane Klientowi przed realizacją zamówienia.
  5. Lokalizacja sauny powinna zapewniać ochronę drewna przed nadmiernym nasłonecznieniem oraz wilgocią — ustawienie w pobliżu drzew, krzewów lub w pełnym słońcu może przyspieszyć erozję drewna, co nie podlega gwarancji.
§9 Prawo odstąpienia od umowy
  1. Konsument ma prawo odstąpić od umowy zawartej na odległość w terminie 14 dni od otrzymania produktu.
  2. Prawo odstąpienia nie przysługuje w przypadku produktów wykonanych według specyfikacji Konsumenta lub służących zaspokojeniu jego zindywidualizowanych potrzeb, zgodnie z art. 38 pkt 3 ustawy o prawach konsumenta.
  3. Jeżeli sauna została wykonana na indywidualne zamówienie Klienta (np. niestandardowe wymiary, wyposażenie, kolorystyka), odstąpienie od umowy po rozpoczęciu produkcji nie jest możliwe.
§10 Reklamacje
  1. Sprzedawca ponosi odpowiedzialność za zgodność produktu z umową zgodnie z obowiązującymi przepisami prawa.
  2. Reklamacje można składać:

§11 Gwarancja
  1. Jeżeli wraz z produktem udzielana jest gwarancja, jej warunki określa odrębny dokument gwarancyjny.
  2. Gwarancja nie wyłącza, nie ogranicza ani nie zawiesza uprawnień wynikających z przepisów o odpowiedzialności za zgodność towaru z umową.
§12 Ochrona danych osobowych
  1. Administratorem danych osobowych jest firma TimberCraft.
  2. Dane osobowe przetwarzane są w celu realizacji zamówień oraz zgodnie z obowiązującymi przepisami prawa.

§13 Postanowienia końcowe
  1. W sprawach nieuregulowanych zastosowanie mają przepisy prawa polskiego.
  2. Ewentualne spory będą rozstrzygane przez właściwe sądy zgodnie z obowiązującymi przepisami.
